CALIENTE TOURS, with National Tourism Registration No. 605, hereinafter referred to for all purposes under the General Tourism Law as the operating agency, on the one hand, and the person making use of the services offered through this voucher, whose purpose is the provision of tourist and ecotourism excursions, hereinafter referred to as the user, on the other hand, agree to enter into this tourism services contract, which shall be governed by the following clauses:
FIRST: The operating agency CALIENTE TOURS agrees to transport users to the previously agreed tourist destinations, providing them, through the assistance of duly accredited professional guides, with instructions, orientations, information, recommendations, and support to facilitate the understanding and enjoyment of tourist sites, places, and destinations of interest.
SECOND: The user agrees to pay the value of the services provided and to comply with the departure and return schedules established by the operating agency.
THIRD: The user agrees to follow the instructions, orientations, and recommendations provided, including: always remaining with the group, personally taking care of their belongings, not bringing jewelry, precious metals, weapons, ammunition, explosive or flammable materials, corrosive substances, or objects that may endanger the group or tourist destination; not entering unauthorized areas or zones; not exceeding the limits of their individual abilities; and, in general, complying with all instructions and precautions provided by the guide before departure or during the excursion.
FOURTH: For their protection, the user agrees to wear life jackets in areas indicated by the guide. The user must also use sunscreen and insect repellent, which are not included in this package, and wear appropriate swimwear for their safety and care.
FIFTH - LIABILITY CLAUSE: In the event of non-compliance with the total provision of the contracted tourist package due to force majeure, unforeseen circumstances, decisions issued by competent administrative authorities, accidents, strikes, riots, shipwrecks, earthquakes, hurricanes, THE OPERATING AGENCY shall refund the amount paid by the user.
If the tourist package is interrupted due to force majeure, unforeseen circumstances, decisions issued by competent administrative authorities, traffic congestion, accidents, strikes, riots, shipwrecks, earthquakes, hurricanes, significant delays, cancellation of boat departures, non-compliance by ground transportation providers (when included in the tourist package), or issues related to service quality, the user shall be refunded for the services not enjoyed, deducting any applicable expenses.
If the user, due to a certified illness or force majeure, is forced to suspend the contracted tourist services, the OPERATING AGENCY shall refund the value corresponding to the unused services, excluding expenses effectively incurred or that may subsequently arise due to the cancellation.
If the user decides not to travel, the amounts paid toward the program price shall be refunded after deducting the following percentages, calculated based on the total price of the tourist service:
30 calendar days before the tourist package date: 10% of the total package value.
20 calendar days before the tourist package date: 13% of the total package value.

The OPERATING AGENCY shall inform the user of the pertinent recommendations to facilitate transportation to the Rosario and San Bernardo Corals National Natural Park (PNN Corales del Rosario y San Bernardo), as well as other prevention and safety recommendations.
The user must pay 50% of the tourist package value to secure the reservation. The remaining balance must be paid no later than one day before the reservation date. This amount shall be credited toward the total cost of the tourist plan.
In cases of overbooking of the services offered or agreed upon, whether partially or totally, the OPERATING AGENCY shall, at the tourist’s choice, provide other services of the same quality or refund or compensate the agreed price for the unfulfilled service. If it is impossible to provide a service of the same quality, the provider must contract a third party, at its own expense, to provide the service.
